My wife is apply for AP renewal. She has her AParole until oct, 2,2008. She is travelling to india this week for three weeks. Can she apply for renewal and travel to india. Is it legal or does it have any replications.

I just do not get who is the plaintiff (accuser) in your DV case if your wife is on your side? Do you have a copy of the complaint filed in court? You can PM me details, if you want to. To me it looks like there is no ground for any case against you if your wife does not want to push it.

Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
You can extend your H-1B. Why is EAD your only option?

Most of the folks are missing the point about the prior years approval numbers. All the approvals from 2004 - 2008 are padded with huge visa number from FB spillover and the recapture provision of AC21. From this year onwards we have to live with the usual ~3K per country per category limit. This is the reason why Charles Oppenheim is predicting decade long wait for EB2 I/C and all EB3's. We continue to beat down Oppenheim claim with our own numbers, but he knows more about visa numbers than any one of us.
Let us dream about recapture being a panacea to the problem. There is only limited amount of visa's to be recaptured (~180K) even with that not all categories can become current. Also during that last recapture debates there where lots of suggestions to stagger the usage of recaptured visa over a long time frame like 5 yrs. Even with recapture, the date movement will not be rapid, but it will be remarkably better than what it is now.

I have seen lots of people posting more than 300+ in this forum and never contributed a dime. If you ask they shamelessly say it is not mandatory to contribute. Everyone knows it is not mandatory, but if you are not self centred and stingy, you will feel to contribute at least once if not recurring after spending months on IV forum.

I'm not sure about the usefulness of this poll? If you look at the percentage of people applied on 2nd July, it is close to 70%. Assuming some error in the polling percentage, this poll indicates that atleast 50% of people have appplied already on 2nd July. As per the press reports, USCIS has received around 55000 applications on 18th July. That means another 55000 people only are going to apply by 17th Aug making a total of 110,000 plus minus 20,000. I do not believe this number and the poll. Any arguments here?

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.

You need to understand why your company is paying only 85K. Your base compensation is 85K, then you have another 10% on top of that as bonus. Also your Health/Dental/vision Insurance will be close to 15K payed by the employer. Also they pay Social Security at 8% base pay + Your H1B and other legal Expense for you and family. This will put your total rewards/compensation well above 100K.
I am not trying to say that your present company is perfect, but these are the common expenses for a company , Thats the reason even if you get hired by the direct client your salary will not increase very much. Companies pay 180$ to the consulting companies for the following reason
1) You are not their employee, so $180 per hour is all they pay ( No benefits, No H1b Legal hassles etc)
2) They Hire consultants for a particular project for a set period of time. After the project is over, they can have the consultant "released" from the project.
3) They dont want to hire independent contractors, cos, if the guy leaves in between the project, its the responsibility of the consulting company to replace your position with another qualified person.In your case, they need to find another candidate with your technical expertise, which is not very easy.Very few Companies wants to take that risk.
You need to look at the total compensation rather than your base pay

if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?

In my humble opinion, if people who have been illegal in US for over 5 years are granted legality, then the govt should
1) Close the backlog processing centers where our cases have been languishing for years
2) Grant us green cards if we can show minimal proof that we did infact file for permanancy legally at some point in time.
I mean COME ON guys..the government is giving legal status to more than 10 MILLION illegals in this country, yet when it comes to 300,000 tax paying, qualified, LEGAL, degree holding H1B workers, the same government is penny pinching and trapping us in a bureaucratic paper nightmare. What is 300,000 when compared to like 13 Million?? Its a drop in the bucket. Do not forget that our employers have paid big bucks for every H1B, and additionally paid for the creation of the backlog reduction center, where they are painstakingly poring over each and every case with a toothcomb.
