    someone please explain me how complete agreement works. I am working for the client through the main vendor who has a noncompete agreement with my employer (This is signed by my employer, not me). Now I am planning to leave my employer but the client is interested keeping me in the project through another vendor. Can someone explain me if it is possible?

    Since the Noncompete is between my employer and the vendor, how am I responsible since I didn't sign anything? Don't laugh, may be I am ignorant

    This is exactly what I did in the past and my desi employer could not do anything because I never signed anywhere, it was between him and the vendor.

    I agree with this....File a new labour and you need to get the 140 approved. Once it is approved ,you can reclaim your old priority date for 485.

    dont file a second 485. Wait for teh second I-140 to be approved, then just interfile this into the old one. Did you already request your older PD when you filed this new I-140? Thats the stage where you typically request teh older PD, though you can also do it when you request to interfile.

    New I-140 getting rejected should not have an impact on the old EB3-I-140 as long as the denial is not something that can be a reason for denial of the older one. So if this is denied due to ability-to-pay, or not qualifying for EB2, you are still ok as long as you had qualified properly for that older one. In many cases USCIS has gone back and looked at teh first I-140 when a new one is denied, to see if the older one also has the same problem.

    If I read your profile right, you arrived in US in April 2005 flied for LC in July 07. I think that is a different situation than someone working in H1B since 1999 (F1 since 1996). Do you know anyone in H1B since 1999 and without an EAD option? I suppose waiting 14 years is very different than waiting 5 years..

    This one was really difficult for me to evaluate because of all the openess, but I felt myself gravitating more towards the forms in number 3. Since it was the form that attracted me, I downloaded and cropped to make the fence the focus (since that's what grabbed my attention initially). I think I like the crop sans sky where only the wheatfield ( or is it oats?) and fence posts show the most. I know it has less complexity than the entire photo; maybe I'm just into simplistic and minimalist this week :)

    My case:

    Worked with Co. A from 2000 - 2005
    Labor filed in EB3. Priority date May/2003

    Worked with Co. B from 2005 - 2008
    Co. A Labor approved in Feb 2008
    I-140 filed and approved in Mar 2008
    I-485 Filed in June 2008 as future employee

    Working with Co. C from Nov 2008 on EAD.
    Now Co. A filed for chapter 11 and closed their shop.
    Atty. from Co. C said to file AC21.

    What are my options ? Should I file AC21 immediately or wait till my case comes up for processing ?

    Anyone in similar situation or have an idea next steps.

    I had to generate paystubs for my wife from Jan 07 to May 07 due to recent USCIS goof up. She started working from May 07. However all the paystubs generated ( 5) , have a pay period from 05/01 - 05/31 and pay date is 07/11

    Does anyone know if it is ok to have the 5 paystubs with the same pay period. The Lca talks about salary per year. The employers claims that it is ok. What should I do in this case. Any suggestions are highly appreciated.

    How did you "generate paystubs for wife"?
    Would you please explain.

    This year, BusinessWeek published the PT MBA rankings. But in my view, there is no real market value for PT MBA Rankings. Employers/Recruiters don't really care for PT MBA rankings & they in fact still go with the same FT MBA ranking perception...

    BTW, here is one excellent article that tries to consolidate the US MBA Rankings given by various media agencies into one list...

    I had sent my 485 app to Nebraska. However, the receipt number starts with WAC.

    Should I send the EAD renewal to NSC or CSC??

    Please let me know.

    RN starting from WAC. But I filled EAD in NSC. Also have RN for EAD. It does not matter. You have to file EAD based on state you live. Because of July fiasco they had sent 485 cases everywhere so those RNs are from all over.
    But for EAD it does not matter where 485 was filed only thing that matters in where you live.

    As Per my knowledge it is not nessesary that all approved I140's will have a A#.

    Senior members please correct me if i am wrong. Also i would appreciate if you can explain what is the criteria to get a A# in case of approved I140.

    it's the A# in your 140 approved petitioin.
    Generally spouses won't have this until they get the 485 receipt so they can leave it blank in the 485 application but the principle applicant should have from the 140.

    For those who think that this is good and will not affect them -

    What we are hearing now in the news is just the tip of the iceberg. It is just ground work to justify tougher measures against employment based immigration. If it continues, CIR will be passed giving path to citizenship to ILLEGAL immigrants without any measure for employment based immigration. Remember, the only folks who have been in influential position to support EB immigration has been big businesses (like Microsoft, Oracle) and AILA. With the rising unemployment rate, nobody will listen to these businesses. With the indictment of (even a few) cases of H-1B fraud, AILA will not be able to fight the impending tsunami against legal employment based immigrants.

    If we don't do anything illegals will be citizens while people with H-1 and even EAD will be forced to go back.

    Can't agree more. This is how it starts - Divide and Rule. First it was the TARP recipients only. Next will IT companies. Then it will be EAD and maybe finally the Green Cards.

    Not anymore...

    EB2 India followed by EB3 India. If we take this "sampling" of information with a mild grain of salt, then it still does tally up with the distribution of the retrogressed dates. EB2 IN is U, EB3 IN is mid April. EB3 RoW is further along down the line.. not many illegals coming under RoW.

    Manny, in your next poll you might want to atleast get the 2002 & before, 2003, 2004 2005, 2006+ PD distribution of EB2 India and 01Apr2001-30Apr2001, rest of EB3 India. I think once those 245(i) illegal buttplugs are out of the way, EB3 IN should move at a good pace. But that may not happen until 2012-2014.

    I am on my 7th year H1B. I got a 3yr extension from my current employer based on approved I140. I have the I140 receipt number but do not have a copy of 140 (my employer refuses to give it).
    I also do not have the LCA for Perm filing.
    My 485 has been filed more than 6 months ago.

    I do have the new I797 (till 2010) for my H1B extension from my current company.

    1. Is it possible for a new company to do my H1B transfer without a copy of I140 ?

    2. Is I140 required to do EAD extension ?

    3. What are the consequences of not having an actual I140 copy with new employer in future.?

    If 180 days have passed after I-140 approval, then there is nothing to worry about not having a copy of I-140.

    I have a similar question.

    I have approved I-140 using which I have received 7th year H1 extension for 3 years.
    I am planning to change my job now. I understand that when my new employer files H1 Transfer they would need an approved I 140 from the previous employer to request 3 year extension. However, my previous employer is not giving me the I 140 approval notice. However, I have the I 140 receipt notice. Can I use that for my H1 extension/transfer with new employer.
