One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.
Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.

Here is my scenario...
1. Applied my first EAD thru some lawyer (hence G-28)
2. I am planning to renew it on "my own"
Can I renew EAD without Attroney help... I know the answer "YES" but the main question is... do I need to inform USCIS saying that I want to withdraw my lawyer's and hence G-28 which was filed along with my first EAD?
If anyone are sucessful, please help me...My question is not on how to self apply EAD..My question is whether we need to inform USCIS about G-28...

Hi,
I finished my six years of H1B in August 2008. I filed my I140 with concurrent filing in July 2007. I also received my EAD card (pending I140) but I never used it. The time has come to renew my H1B for the upcoming year. My employer filed I129, which was approved by USCIS. Now my employer is asking me to renew the EAD but I don't want to spend the money. Do I have to have the EAD with my H1B? What do you guys think?

I applied for H1 on Oct 10 2010. I got an RFE - (relatively benign - proof of labor cert filing) on Feb 22. My attorney responded and they changed the status to RFE Response Review on March 3rd. Unfortunately, I'm planning to go to India on the 26th.
- Would upgrading to Premium help at this time?
- What is the typical response time between RFE response review and decision?
btw, this application was processed in the Vermont Service Center.
Any help would be greatly appreciated. Thanks in advance.

Can I travle outside US after applying for conversion. Need some one to response ASAP
If you travel out of the U.S. while an application for change of status is pending the USCIS will deny the pending change of status application.

From Matthew Oh's website, sounds like labor sub will be history from next week.
What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?
Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?
