I do not think they told us the lies, I think we raised our expecations too much, we did not do our homework. its one of those advertisement gimmicks,
where they say everthying is free and at the bottom of the page there are all kinds of restrictions written in small fonts.

how many of you realize that the queue gets longer every year by _seven_ years? how many people applying for h1 know this?
its not that i didn't read the fine print. _they_ kept the fine print. i was never even allowed to see it.
and when i asked for the promotions etc due to me for my work, they said, you're free to leave.
the intimidation is clear.
in hindsight, yes, i should have paid a US lawyer consulation before coming here. but before coming here i've worked in 4 countries and the experience was always nice.

I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.
Hope this helps others.

Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Just kill the time???
When cops knock out your room, handcuff your hands on the back, force you stay down at the corner , if you could keep calm and state very clearly. I can only show my respect but unfortunately I did not make it. This is my first time. :( Should be the last time either.
Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.
I create this thread just wish listen your opinion and try public view how much chance I can win the jury trail. Some of your advice is really helpful and I will take them.
My wife is writing the mail to DA and wish it helpful to my case. I will have several rehearsal with my attorney in coming weeks. Anyway, we will fight for the justice and not accept that ridiculous battery charge.

No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.
This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.
Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.
My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.
I feel that police and people are considerate to situation.
So, based on my experience of sevaral such things happening due to ignorance and past habits:
.... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
.... If you have any cultural example, explaining up to what level it is acceptable in your society.
You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

If we need to facilitate our provisions, this is what we need to do rather than sending any email or calls. They will have 0% effect at this time. Infact anyone sending emails from a junk email ID without revealing their name, phone number and home address in the email is wasting their energy and hurting themselves and others in this community. Lawmakers want to hear from their constituents and you need to be a real person. An office should be able to contact you and know you have a legitimate concern in their constituency. You should urge others not to undertake such misguided attempts of spamming lawmaker offices and follow a proper process instead. Ask people on other websites who are sending random emails to come to IV and join our advocacy effort. Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
The current since 2008 spillover Eb1>Eb2>Eb3 regardless of country is called horizontal spillover.
However see in Horizontal spill over Eb2 India backlog takes of the numbers (14k in 2008)
In vertical spill over Eb3 India backlog takes the numbers(17k in 2007)
So either method wont help Eb3 ROW. Its a double whammy.

That is correct! The bills in the house and senate coming up for discussion does not mention visa re-capture. However, Please look at the titles-don't they sound the same. The contents are different. The content of S.424 is to give permanent residents the same STATUS as US citizens so that they can sponsor their wives, parents, brothers, sisters and doggies...So an amendment is necessary. That's why I have written in the original post-
'The second bill Uniting American Families Act is in the US House. Though the intent of this bill is not the same as the senate bill S.1085 noted above; an amendment can be made to make it the same. Currently, they are scheduling a House hearing on 3rd. June, 2009 for that bill.'

you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...
I am sorry you had a bad experience...possibly because of the officer's ignorance...worth a complaint...maybe you can draft something with your lawyer....don't just ignore such bad behavior...

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...
My history - Made $0 contributions so far..and have been wanting to contribute for a long time now..but keep backing away..

If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.

My kids didn' go to day care until they are 1.5 years old, then they want to babysitter , they started going to day care after 2.5 years. Day care is right place for kids after 2 years, because they need other kids to play, staying home is boring for them. I have personally experienced this.
