    We me and my husband took infopass on 95th day of reciept date
    (11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

    Everyone is acknowledging that Recapture Bill will help everyone, but no one is willing to do anything.

    Next month, Congress will be in session for a very small interval of time, then why not try to do our best as much as we can regarding this bill.

    Maybe I am wrong, but isn't the regulation specific to state that required filing fees must be paid by the employer? There may still be attorney fees which may be borne by the employer or the employee.

    As regards the 12 month contract, if the contract is written appropriately, it will probably be binding in a court of law. It all depends on how the document is drafted. My employer hires Indians and Americans with 1 to 3 year contracts. The employees who chose to leave before their contract expired did pay back a set fee to my employer. There is nothing illegal about that. But again, it all depends on how the document is drafted.

    Interesting highlights:

    Employment based immigration : 159,081 in 2006 of which 55.1% were dependents.

    Members interested in Statistics are welcome to peruse the Yearbook for the proportion of each country and then extrapolate it out to when their respective dates will be current (I am sure it will not be a pretty picture for India and China)

    The report is for the period October 1, 2005 through September 30, 2006. Of the 159,000 or so mentioned above, 36,960 were EB1, 21,911 were EB2 and 89,922 were EB3 (I guess this number includes the 50,000 that were recaptured and given to nurses).

    Of these numbers, 32060; 20939 and 60390 were AOS.

    Furthermore, of the AOS cases, 18959; 10708 and 29537 were spouses oand children in the respective categories.

    AND FOR THE KICKER:

    total EB persons from India in 2006 : 17169 and 9484 from China ONLY! (includes spouses and children) with the honor going to Philippines at 23733!

    Hi I am applying advance parole for the first time, I am a july 2007 485 filer but never really cared to apply AP. Now I am planning to go to India in december what are my chances of getting my AP approved before that. Below are my case details:

    Hi,

    I have a question about leave of absense. Does it mean that you are still employed with them if you apply for LOA? If yes then you cannot work for another employer at the same time, not on H1B atleast.

    I would like the gurus to share their opinion of the following option:

    Join the new job and start working there. If there is an RFE in future then you can go to your old employer and ask for a offer letter (with the promise that you may or may not joined them) and also one from your current (old) employer. If the adjucating officer says that the letter from the current employer does not qualify under the same/similar category then you can show him the letter from the old employer offering you a job. This will satisfy the requirements of having a job offer at the time of adjudication. Though in this case you will have to join your old employer.

    Gurus: Is this possible? Or are there kinks in this theory?
    LOA...means I am still employed without benefits ...at my old company.
    what you said makes sense..this is how I am looking at it

    -join new company
    -donot send in ac 21 paperwork
    -if i have rfe send in paperwork from present employer which will only be a generic letter----(i don't know how much detail uscis likes)
    -the reason i want to do LOA is that this way i will be sure they will not revoke i -140
    -what do the gurus feel ?

    You have to remember that Schedule A is a one time 50K cap. DOS mentioned that the category will be eliminated from VB soon. They expect to hit the 50K cap by the end of this month and thats why they will not accept any more new applications from then. So who ever were able to sneak in under that category, will get their GC. There will not be a Schedule A category unless congress approves again.

    Then that's good news for us.

    You knew my attorney tried me with DA question mode. I can only say it is very challenge. He will only ask Yes/No question, and interrupt you immediately if you try to explain something. I believe any man would be emotional in that scenario especially you really feel innocent.

    Just an example, I have not said "push my wife to chair ", but in my statement, DA might ask "Does Police lie for his statement" I'd like to say "it is language misunderstanding". But DA would insist on Yes/No question and interrupt while you just open the mouth.

    We will rehearsal more before go jury.

    I am sure the jury will say that you are not guilty if your wife supports your side of the story. Remember, the verdict should be unanimous. So go for jury trial and request a court interpreter to make sure there is no language barrier.

    But to answer questions :

    out of all useful land , I guess africa has lots of uninhabited land!, so someone would not mind selling! Its not to offend anyone. I have great respect for africans, being aware that we come from them!
    Me being an indian upper class guy, and this OBC thing going on back home, I dont think I belong to that country that much, where me/my children will be discreminated against!!!

    Here are my thoughts/suggestions:

    Its good to know what other people are doing.. but when the decision time comes only ur personal things that matters

    Ask your self questions like some of the below:

    1) how long u are planning to stay in house/US - based on this u can use rent vs Buy calculators to see which option is better for you.
    2) is ur monthly income (Net .. not gross) is enough to buy the house u want? - means house in good location, with minimum sqft, enough rooms etc
    3) is this right time for you or r u just want to take advantage of 8000/- pay back - if so please think twice - you can save or get back this money by other means if you carefully plan. Just see if you are better off purchasing house next year.
    4) if the house purchased, will you able to fund any future investments?

    many more personal things to consider...

    so THINK ,... THINK, and again THINK before jumping on this HUGE investment.

    Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
    If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.

    Dear Nixtor, we should not question that when they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.

    At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

    I am neither questioning any one nor asking any one to have us on their website. If any org all of a sudden starts giving us more credibility or negative publicity ( I am not referring to USINPAC here, So do not mis construe my point again) I will definitely take a moment to retrospect and see if there was a common goal. If there was a common goal indeed, why we have not worked together? I just pointed out the feelings some people on this side of aisle share. I threw them out there, while others chose not to. I just looked around and why any one is supporting now and not before. Hey, Never late than now. I, personally am more than willing to know why the American Indian Citizen community has always ignored this heavy weight issue, especially when the drums beat heavily on how to retain the culture.
