    Get over with it bunch of whiny losers. Someone can can and is willing to do the job cheaper than you.

    Think from your client's perspective:

    1. Why should he pay you more if he can get someone for cheaper price?
    2. Are you willing to do the same job for the salary that is offered by TCS, WIPRO?
    3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful.
    4. YOU guys want to leave companies at will but the companies should not replace you at will?

    If you were bringing in value to the client that they cant get from TCS/WIPRO then you will have the job. Get some more skills, be best in the business and be smart. Know what it takes for long term success. You have to be on your toes all the time.

    - H1 is still valid even if your 485 got rejected until you get notice to that regard separately.
    - If you have not shifted to EAD,You can continue working on H1

    I continued working on H1 during my MTR approval process( Sep08 to Dec 08). My 485 got rejected due to earlier employers revocation of I 140.

    Attorney gets the notice. Find out from all your attorneys and their staff if you have access to do so.

    Call USCIS and find out the reason of rejection first or take info pass and find out the reason and act fast. You have already crossed general response time(30 days normally).

    My mail to Capital One after getting the initial response:

    Thank you for the reply.

    I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.

    Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

    Response that I received for the above email:

    Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

    HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.

    The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.

    If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.

    If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.

    My wife and I are planning to apply as dependents for each other.
    Reasons:
    My company is doing so-so.
    On the other hand if and when we have kids, she would like to stay at home if possible.

    The only thing that is not clear is we probably should file only 1 EAD/AP.
    For now, we are thinking we will apply for EAD/AP through her I140.

    Thank for bringing that up.. I had the same inkling, of course , w/o anything to subtantiate when I first saw these "inventory" figures.. I had also posted couple of times this poser.. esp those who were in the math crunching mode to determine the D-days baed on our PD..

    This makes such a huuge difference to the queueu.. I am reminded of a post who said he starts the day happy when he sees such numbers and ends with kicking his dog... Gosh I need a dog!!!!

    Wanted to update on my Infopass appointment, I have multiple 485's pending based on separate 140's(one approved and other pending) with different A#'s and at different service centers. So was bit concerned. The IO informed me that all my 485's and 140's have been consolidated and all applications are in the same file at one service center so nothing to worry about. She also told me to use the A# from the first 485 for future communications with CIS.

    People who have multiple 485's pending, my word of advise is its not a problem. CIS takes care of it. And this is true even if you have different A#'s.

    My understanding is that this is incorrect:
    In the old system any unused visa from EB3 Row would got EB1 India/China first and then EB2 -I/C and then Eb3 -I/C.

    What you described ("last few rows") is what they are following now, Einstein!!!

    [Except this piece EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)]


    So what will be the flow? I guess the following

    EB1-> EB3-ROW (until current)
    EB2-ROW -> EB2-I/C

    Once Eb3-ROW becomes current

    EB2-ROW -> EB2-I/C
    EB3-ROW -> EB3-I/C
    EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)

    No I did not contact KCC.

    In the below quote gpawar says that she used the case number to find out from KCC on what date the H1 was approved. So that means we need a case number to call KCC. My question was when and where do we get this case number ?

    I'd posted a note earlier. I haven't received any updates yet. I am in contact with 4 other people who interviewed on 4th Jan and are still awaiting a reply. The kentucky number mentioned in one of the replys confirms the date on which our H1 was approved. When you call up the number, on mentioning your case #, it pulls up the date on which H1b was approved.

    Could anyone who's received a email/ call please post a message to the group, indicating the wait time and date of the first interview?

    If EB2 row perm hits 10000 apps thats it pd wont move a bit. That will happen as soon as hiring starts again. This will happen any time, if this not happen until sep 2010, then EB2 has a chance. There are about 15000 (approx) EB2 Row apps siiting ducks in Perm centers, if ROW PErm eb2 approvals start flowing then we are just stuck. It all depends on EB2 Row Now. That is the one we need to watch closely.

    Even if the economy improves, it will take some time to plan the recruitment, then hiring people and then they will take sometime to start the PERM process and then filing it and getting the approval. FOr all these things to happen, it will be a minimum of one year ad even it may cross two years. Don't bother too much about this.

    I prefer the economy to improve over getting GC, if economy is good we will not have to worry about getting a Job if laid off and also, if we have EAD we can change jobs easily and many of the problems without the GC are not that siginificant then.

    I'm not blind to stereotyping in this forum or elsewhere. It's not you vs. them kinda thing. You ARE stereotyping based upon some TRUE things but it is still stereotyping, isn't it.

    Also, you understood some of my comments wrong. All I was saying is that due to big ISV's like TCS/INFY/WIPRO and mushrooms of bodyshops the actual worker gets pennies on a dollar and they keep the booty. So it's not the worker who causes wage depression it's the circumvention of the spirit of law that these companies do which causes it. I say "spirit of law" because they still stay within the legal framework. As far as offshoring is concerned it's a big discussion in itself and forces of capitalism and globalization are at work. None of us can prevent that but we can counter it by moving up in the value chain.

    The scenario you described about modus operandi of big Indian ISV's is 100% correct but to generally imply that Indians are 1/5th as good as Americans when it comes to IT (50 member team vs. 10-12 member team) is a supremacist attitude and completely untrue.
    It is true that the Indian counterparts are usually of much younger age but rarely substandard for the job. Companies realize that IT is no-longer considered rocket-science and they can save a few bucks. Try to think objectively keeping personal impact aside.

    Now regarding overall economic input of immigrants there are issues broader and larger than you mentioned. Some of the smaller points you mentioned are true but you are completely missing the big picture. We can discuss that in a different thread :)

    When Bill Gates says best-and-brightest it applies to individuals and not a VISA category, he's not lying. Among the 65K every year you'll find people from all skill levels, cream-of-the-cream to just-about-ok, and a few rotten-apples too. The immigration system is not designed to test skill level. Overall it's old, irrelevant and doesn't help anyone. It needs to be re-designed but unfortunately people are divided on fake lines and ignore the real issues or rather real solutions.

    Although you have said it differently but you are right that solution to mine and your problems lie at the same spot, a modern, common-sense, immigration system that promotes best-and-the-brightest (Indian and American) and discourages exploitation.

    I occasionally happen to say something they like to hear. I may criticize, but I try to appreciate where it is warranted. World doesn't run by criticism alone.

    The plus point with you is, you never use abusive language and your arguments (at least for the most part) look sane and rational. I wish more intelligent people would interact with you so that the discussion results in some good knowledge being produced.

    Apart from that, what I dont understand is that you say that unless spillover is fixed not even visa recapture can help EB3i. Are you familiar with the numbers for this?

    Today you have proved how low you can get. You have criticized H1/L1 numerous times before and today your show criticized O1 visa, which is popularly, know as elite visa. This visa category is created for persons with international fame such as Nobel laureate, international fame athletes, musicians and entertainers. Today your show criticized none other than famous soccer player David Beckham. David is a highly successful international soccer player and his stature is often compared with top ten soccer player in the history of soccer. such as Pele, Maradona, Becanbaire, Platini, Ronaldo, Zidan and others. He is coming to play for LA team not to snatch your American middle class job. On the contrary he is going to help local economy grow when fans will completely fill the seats of soccer stadiums all over the USA. Unlike football soccer is not a mainstream American sports and most of the match organizers face hard finical decision to organize large soccer events. Wherever David Beckham goes fans follow him and all those empty seats will be filled within no time. WHEN STADIAMS ARE COMPLETELY FILLED FOR A MAJOR SPORTING EVENT, IT IS THE LOCAL ECONOMY THAT GETS THE MAXIMUM BENEFIT.     If you really care for middle class Americans why don�t you run for the President post? Can you show us one example where you have contributed to some organization that helps inner city kids (mostly blacks) improve job skills? Can you show us one example that you have motivated and convinced one high school drop out to go back to school and that kid followed your advice and went back to school?

    There are people like Governor Swaznegar (an immigrant), Magic Johnson you are silently doing exactly just that. These fine gentlemen created and funded (still continuing) organizations that provide on going job related training to inner city kids in Chicago, New York and many large cities so that they become productive American citizens.

    Come on Mr. Dobbs, show some character. Don�t just make publicity stances. Change America and provide equal opportunity for all. As a first step just become a mentor of Big Bother & Big Sister organization ( it won�t cost you a penny) and motivate a high school drop out (you may pick up a white kid because everybody knows you do not like other color) to go back to school. Present him on your show and make him as an example of how America is changing to face the challenges of globalization. The Americans are eager to see some character here. Come on Mr. Dobbs what are you waiting for!
