Either employers think EAD is the student EAD which needs to be converted to H1 or they are ignorant.
My suggestion would be to not bring it up....and if it does come up tell the employer that you have work authorization and that the employer doesn't need to do anything. If that doesn't work, then someone is actively discriminating...

I am not sure what is happening. When I went to USCIS during Infopass, the officer at the time told me that my case will be looked upon when the notice date comes up.
MY priority date is april25 2006 and the notice date was 09/18/2007. I didn't believe him. Even I raised the question in one of the forums and other guys shot me down saying the notice date is not important. But now I got an LUD on 09/19/2007 and that was the reason why I raised this question to you as well as HIINVIN66. I am assuming that the applications are looked upon based on the notice dates. If they under EB2, pre adjudcated and visa numbers availaible, MAY BE MAYBE we get green cards. IF not, We have to keep our fingers crossed. Let see what happens.....

There is nothing called h1b jobs. There is no job reserved for someone on h1b. So to say that people on l1 are taking h1b jobs is kind of funny.
At the same time, that anti-immigrant l1fraud is here to scare people and is against the community. But because most people here are not on L1, so most people are agreeing with l1fraud user. As if L1 folks are getting ahead of us, and L1 folks are taking our jobs, same mentality and outlook as that of the disgruntled programmers at programmers guild. Maybe there is nothing wrong about that because, humans as species have always behaved as part of the food chain, eating and living on the ones below us. Likewise, people here just want to blame someone else for their problems, including delay in GCs, on others on L1. So the entire focus of this thread is "l1fraud". From time to time, some anti-immigrant or someone from another site come in and divide people here without much of an effort, that we are just a bunch of losers, yes that's right, people who play into the hands of anti-immigrants and people who play into the designs of the agents of other agenda's are nothing but losers. In essence what the memo seems to state is that I can have another employer file an I-140 petition, and if approved, simply substitute the I-140 in my existing I-485.

It is possible to use your new approved 140(EB2). Your date are current and do request USCIS and go in front of GC line. Good luck.

Trying to wrap my head around 245i cases. All primary applicants you were physically present in the US on Dec 21, 2000 were eligible to file 485 before April 2001 (with approved labor + approvable 140). Spouses and children of those primary applicants who were not in the country have to apply using CP. So the data provided by USCIS does not contain all those CP applicants. BUT as the dates were current till 2004, USCIS/DOS HAD to know the exact number per country as consulates have to report CP applicant numbers. The only possibility for the discrepancy you mention is that USCIS horribly screwed up and we may have hundreds of CP applicants who are derivatives of 245i. Conspiracy theory ?? LOL. Man, we have to just laugh at our plight.
No racism intended here but historically speaking number of immigrants from Mexico/Caribbean/China probably had more numbers in 245i than India. So, you question remains interesting inspite of the CP applicants possibility I mention above.

I DO NOT support this law suit idea but I really admire SunnySurya... not because he/she is planning to file lawsuit but because he/she has been really polite and patient to so many insulting, taunting and name-calling posts "personally" against him/her.
Again, I am NOT supporting actions of SunnySurya..... but admiring the patience and politeness....
My first and last post on this thread... hopefully... :)

The link is related to the fingerprinting background check. Almost 100% of the time the automated system returns an FBI record (an existance or not of a "rap sheet"). Only in rare cases when the finger prints are not clear USCIS sends a new FP notice.
The issue here is the FBI name check which returns less than 68% in the automated response. Around 32% of cases (485/n400) are delayed of which less than 1% really may have a negative record most of which are reported by IBIS and finger print check.

immigration relief like recapture, more visas etc require congressional approval and i dont think we will see any till mid 2009 after the election is settled.

All USCIS requests have a priority level 3 - requests WITHOUT specific deadlines. All other problems - bad search criteria that produces too many false hits, the decision to search in reference files for all requests, lack of electronic document depository for NNCP - are secondary. When expedite is requested on the NC, the FBI resolves it in a matter of weeks. In fact, they can process up to 100 expedite requests a week without affecting productivity. That means some requests are just plain ignored.

I just talked to one of teleblend rep (live chat on their website, very easy to do and I can do this during lunch time from office). The guy said they are working on something but was not providing any time line or details. I told him to hurryup else I will switch. Looks like we need more teleblend customers contact them to get this done faster. Guess they are waiting to see what effect or how many customers actually switch to vonage. Teleblend must offer $20 world plan in order to stay afloat in competition. I say this as they now offers $15 unlimited us-canada Vs. vonage $25 unlimited us-canada plan so far.
I'm also using teleblend and will call them tomorrow to ask for the deal...Currently their unlimited india plan is $35 + $15 + tax = close to $55.

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

I believe if you get your Credit score reports from Experian and others, it lists all the addresses you ever lived in USA. You can get free Credit score reports from agency once a year.

The card looks like a credit card, greenish in color (hey, after all it is GC). It does not smell or taste good :D I looked at the card for almost an hour before going to bed. :D
As a 'masterji' one advice to all: If possible, try to complete a graduate degree (M.S., MBA, Ph.D.) from US. Besides self satisfaction, it REALLY helps professionally.

Yes, you can only deposit your passport at the western VFS locations only if you are interviewing at Mumbai. In my case I gave my passport to a responsible friend of mine in Mumbai who in turn was able to deposit the PP with INR 155 as the fee to VFS.
You can not give the passport directly to the consulate, they will not even accept it as that makes them liable for the passports.

Does anyone have an answer or idea as to the job title employer verification letter question ? I didn't see any response as yet so I thought I'd repost the question. So far I've only seen some suggestions on other forums that suggest filing anyways without the letter and waiting for an RFE which might then coax the employer to do the necessary then, waiting for I-140 to be approved and then filing with W-2's (or paystubs -- I don't recall) or waiting 180 days, filing without the letter, switching to a new employer after the 180 days pass and then submitting the new employer's letter.
I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.
This is the letter I got for support of my I485:
Please be advised that Mr. XXXXXX is currently employed by our company. He has been employed with us since XXXXX.
His position is that of a XXXXXXXXX. His annual salary is $XXXXX per year. The position of XXXXXXXXXXXX is still available for him. I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.
This is the letter I got for support of my I485:
Please be advised that Mr. XXXXXX is currently employed by our company. He has been employed with us since XXXXX.
His position is that of a XXXXXXXXX. His annual salary is $XXXXX per year. The position of XXXXXXXXXXXX is still available for him. We intend to continue with the permanent residency process on his behalf at this time, according to all of the terms and conditions set forth in the approved PERM application. XXXXXXX salary will be at least $XXXXX per year once the permanent residency is granted.

My I485 is pending since October of 2006. I had a RFE for medical in april of 2007 and replied quickly. Since then there is no movement in my case. I contacted USCIS several times and they told me that my name check is pending...
