    I guess the genuine companies will move the H1/L1 staff abroad along with positions to meet this requirements if at all this becomes law. What that means is more job loss in US. (Whether US has 50% of total "high skilled" work force necessary to run the operations of all the companies is another important question... I do not think so, may be the senators are considering highschool dropouts to handle the "high skilled" jobs :), I read somewhere about a recent survey and only 27% of 25-45 age group of population has a college degree in all discipline. I will try to find the link)

    Over all, I see this move by senators as short sited and will prove disastrus to America in long run given the fact that no other country in the world is as dependent on technology / research and development as US.

    I also saw a quote from one of the Indian offshoring company CEOs that only 25% of Indian engineers are employable. May be highschool dropouts in US may not be that bad when contrasted against that statistics, after all Bill Gates was also a dropout. Also the dime-a-dozen so-called "engineering colleges" in India that feed Indian offshoring companies are known for QUANTITY and not QUALITY. Indian students go for (or their parents pay for) those courses offered in those colleges precisely because they offer a better future - i.e. they feel they get a good ROI on their investment, even if they don't have the interest or aptitude for Computer Science or engineering. These days, these facts are known to a lot of americans working in IT.

    If H1/L1 visa is restricted, that will give an incentive for americans to acquire a degree in science/engineering, just like the indian students taking courses in india offering a better ROI, as they get the feeling that they won't be discriminated in a job and investing $$$ in education is not going to be wasted. This is what President Obama also emphasized today about the need for fundamental change in unemployment allowances helping to retrain the laid-off workers.

    It will no doubt cut into the obscene profit margins of TCS/INFY etc., as they will be forced to play by the rules.

    I am sure you must have given this information earlier but can you please tell me where did you apply? And was it your first stamping or a renewal case?

    Also are u stuck coz of PIMS or 221 g clause?

    Due to the pending caseload at NSC, the processing time of your I485 application has been extended. Allow extra time for an officer to review your application. Furthermore if all intial evidence was not included with your application or a question arose during adjudication that required a RFE additional time would be needed.
    Your application remains awaiting review by an Officer and you will be notified as soon as decision is made. The service is waiting for VISA availability


    got this message for my wifes SR opened on 07/30, did anyone got the same response?

    Please don't be afraid to share your denial info. At this time, OMB is asking to remove all personally identifiable information from reciept notices. So, we don't have to worry. We will get much attention only with specific evidances. Please do not hesitate..

    I have recieved Omb response since I partificipated in the campaign. But, I have not used AC21 yet. Will be contacting PD_Recap for further direction.

    i am waiting too, for the full month of june my attorney was sitting on my case not filing it as they were busy preparing the doc's for the july filers, finally they filed on july 2.

    finally i received my(and my wife's) FP notice. My ND is Aug 14th and it is from NSC(not CSC). I(my lawyer) never received my Receipt notice.

    Without legislative or administrative reform, EB3-India would be reduced merely to a mechanism which folks would use to extend their H1Bs indefinitely on the basis of the underlying I-140, or a means to lock a priority date while they plan their strategy for an EB-2 petition for a PD port in the future. As some analysts have predicted, EB3-India wait times might get extended to decades without some sort of reform. Not to make light of the situation, but for an EB3-I applicant with a recent PD, the odds of getting a green card through a US-born child (once they turn 21) could become greater than through their own EB application.

    Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because

    1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
    2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.

    so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.

    stay healthy! that is more important than stressing yourself on issues which in the long term do not matter really. (You will get GC on or two rears later in the worst case scenario). cheer up folks:D:D:D


    The law would allow him to port his EB3 PD just like how it is doing now. he will not be in the same situation, isn't this better now?
