If you read the rules closely, the employer is attesting to the fact that the job will be readily available at a future date. So as long as the employer issues a letter attesting to this, there is no issue. If you do indeed move prior to the six months, make sure you amend your H1B for the necessary changes (eg location)

Confirm with the co lawyer also.

Thanks for the info. I may be indeed move prior to six months of filing of 485. Meaning, I recently filed my 485 on July 2nd, and am planning on moving by August 30th.

Does this mean that I can move to a different state as long as my employer issues a letter stating that they would hire me back in the original location at the time of issuance of GC?

Also, what does Amending the H1-B mean? And, would it involve much effort and complications, and would I have to file for the 140 and 485 again?

My H1-B visa expired on June 16, 2007. Extension (I-129) has been filed in May 2007 (before expiration). It has not been approved yet. It's still pending. My LC has been approved on July 09, 2007 and my PD is April 2004. My question is: Can I file concurrently I-140 and I-485? Will my application be rejected or will an RFE be issued?

    Thanks for your input.

    Solong:confused:
Yes you can. As far as I can see there is nothing unusual/illegal in your situation.

I completely understand that nothing is ever going to happen in favor of legal immigrants. However, when I saw what really the dream act meant to do, I just thought we should get some senators involved and aware of the plight about the kids of the legal community too. One of my friend has 2 kids and he has been waiting now for over 6 years every single day of that in perfect legal status. what wrong did the kids do? why dont they compare equal to the ilegal kids who are going to be blessed by this bill if it is passed. I am sure IV might not have enough will for this since many of the leaders might not have kids but atleast look at others who have kids and always face the dreaded scenario of having to uproot them from their schools/friendships in case of immigration-related issues.

Yes India, I totally second it. India as of now is a booming economy and will be in the future, we all are professionals educated if other economies can benefit why cant our own benefit from what we have. People all talk about corruption, corrupted politicians, red tape etc, why dont we take a step towards pushing it down, like once my friend said about putting a website that will expose all of them even a clerk who is corrupted can be captured on a mobile phone and posted on the site.. Just a thought and well being an immigrant means for some time in life you cant even vote(Voting is an important thing in democracy).I believe India will keep growing in the years to come and will be good option .I personally believe being a part of developing some thing even a country is great thing rather than sit on top of something thats already developed by some oneJust a thought.;)

My wife's EAD was also sent back even though we haven't moved. She got all her other receipts. I didn't have her name in the mail box. Wondering if it is the reason but again she got all her receipts, ad parole. We called USCIS they opened a Service Request. It will take a month minimum.

What is the # u called to talk to CSR?

Can anyone suggest me a good health insurance policy for the state of TN? What are the things that are important and what should be ignored? Most of the time I dont understand the technical terms used in it.
Currently I have one from a big health insurance company bought on the internet. I thought I was covered well. Every year they are raising the premium by about $30.00/month. I want to get another one, if anyone has bought from the open market please let me know.

    Thanks!!!

    Hi Nair/Perm,

I am not a returning US resident.

One of the companies sponsored my H1B and I am trying to get the visa stamped in India.

I got the wage report from the company but not the "Unemployment" wage report, so I am confused.

Any help about the document would be greatly appreciated.

Thanks a lot for all your help.

    Have a nice time!

    Thanks & Regards,
    Chak

Yes, it is called Consular Processing. You can apply using I140; Only Caveat being, visa number should be available (Priority date should be current) when attending the consular interview and the visa is employment/family based immigrant visa (unofficially green card) - not non-immigrant visas like H1/B1/L1.

Be fast u only got a month ....

Get in touch with a good attorney, call shusterman.com and get an hour of consultation charges for u.

Tell him the situation, give him the two options. He will point you in the right direction. Remember July is the only month you have a chance. August and retrogress can kick in for Indians.

Let me add one more option to the above 2. Talk to your employers thru whom you got the approved I-140 and ask them to allow you file the I-485 since GC is for future employment u don't have to be working for them for filing I-485 now once 6 months are over with the 485 filed you can port it to ur current employer. Email me if u have questions dr_irshad2001@yahoo.com

    Good luck & hurry ...

This processing dates is just an act or rather a scam. USCIS and DOS will do what they like. I personally know a lot of people who applied there 485 a month after I did during July 2007 and whose priority date was 6 to 7 months behind me and they got there green card in August 2008 and I did not, I am sure a lot of you are in the same position. Whats the point in looking at these processing dates when there is no order or proper manner in which USCIS processes them, it is worse than a fish market. If we are lucky the monthly bulletin dates might move again (I doubt it), even if it moves you just dont know how far it might move, it might be 1 month or even to 2007. USCIS will then issue GC to 2007 and make a fool of 2004 and 2005 folks. I guess we have no choice but to bear this brutality. I for one have stopped looking at processing dates and even monthly bulletin. On top of it we have Obama\Durbin in control of washington, not sure what sort of nightmarish "immigration reform" they are cooking. I am at a low point, for the first time I am fearing I might have to leave US (or might be kicked out of US by Obama \Durbin "Immigration reform") after comming here and staying legally for 10 years and obeying all the laws.

Hi pitha, i understand your frustration but one thing in which the processing dates helps is like in my case, if my h1b extension is pending for 60 days i can call them only if their processing dates says less than 2 months, otherwise these guys wont even answer the call saying call back after checking processing dates.

To second what SITM said in this post, my case (interfiling from EB2 NIW to EB1 EA) was approved on March 30, 2009. My I-485 was submitted in Aug 07 thanks to the July 07 melee. In my case, I had my lawyer do the interfiling for an additional fee. So, I am not sure how the interfiling request looked like. But, I did follow with NSC on my I-485 s after the request on a regular basis and I believe that it helped! AFAIK, it looks like interfiling is not completely hopeless.

Can you please share what steps you took to follow up with NSC on interfiling and did they respond to your requests.

Time to get our voices heard

    http://www.time.com/time/politics/article/0,8599,1896482,00.html?cnn=yes

The first tweet the White House Twittered was not about the weather. It had nothing to do with how the President was feeling, what he was doing or what he wanted for lunch. The First Dog, Bo, failed to receive even an oblique mention.

Instead, the Obama Administration jumped with both feet into the 140-character Twitterverse on May 1 with a one-sentence post on how Americans can learn about swine flu directly by joining social networks with the Centers for Disease Control and Prevention (CDC). "We wanted to use these tools to some end, some effect, some public good," said Macon Phillips, the White House Director of New Media. (See the best social-networking applications.)

So it has gone in the first few months of the Obama Administration. At the new President's urging and by his example, the entire Federal Government has bounded into the world of social-networking. Twenty-five agencies now have YouTube channels. The Library of Congress has begun posting thousands of free historical photos on Flickr. In the past week alone, about 30 agencies, including the White House, have joined Facebook.

"The whole pondering process Should we do it? Should we not do it? has been truncated because the White House is doing it," says Theresa Nasif, director of the Federal Citizen Information Center, which helps coordinate Web outreach. "It's very exciting to be in government."

The federal technology transformation remains very much a work in progress, with several agencies just beginning to grapple with allowing employees to even access social-networking sites. The White House communications team, for instance, is not able to access the government's Facebook postings and Twitter feeds, let alone those of reporters from the press corps, because of filters installed at the White House. (The White House New Media team, which posts on the networks from four old speech-writing rooms in the Eisenhower Executive Office Building, has been able to win an exemption from this policy.)

Still, the Administration has already made great strides in opening up to technological innovation. On Jan. 21, his first full day in office, Obama signed an Executive Order calling for all departments and agencies to "establish a system of transparency, public participation and collaboration." At the same time, White House lawyers, working with other federal agencies, sought to create new "terms of use" agreements with private companies that would allow government to sign up for social networks like MySpace, YouTube and Facebook as if they were just another person. What was once the sole domain of adventuresome government agencies and officials soon became standard policy.

At present, government lawyers have drafted agreements with 10 private social-networking companies. (The tailored agreements take into account certain federal privacy statutes and require that disputes be settled in federal court, not state courts.) Six other private-sector products, including iTunes, are being considered for further expansion, potentially clearing the way for easy iPod downloads of Obama Administration messages.

At some agencies, like the White House, other considerations had to be taken into account. To comply with the Presidential Records Act, every Twitter and Facebook posting, for instance, generates an e-mail record that can be stored with other records. Citizen responses to the White House postings are also sampled and archived for the sake of history. On Monday, to coincide with the announcement of a crackdown on corporate overseas tax havens, the White House Twitter feed asked followers who now number more than 40,000 for their reaction. Jason Furman, deputy director of the White House National Economic Council, responded to three of the questions in a follow-up posting, which was linked to the White House blog. The questions, far from softballs, led to a discussion of the difference between statutory and effective tax rates, among other things. (See the 50 best websites of 2008.)

Other areas of government have had success on a far greater scale. The CDC, which began experimenting with social media three years ago, has created a raft of YouTube videos, podcasts, webpage widgets and Twitter-size feeds to inform the public about the latest news on the H1N1 virus, also known as swine flu. Between April 22 and May 4, the CDC received 1.2 million views of flu-related material on YouTube and 46.6 million Web-page views, and attracted 99,000 followers on its Twitter feed "CDCemergency," which provides breaking updates on health issues. Janice Nall of the CDC's Center for Health Marketing says the agency is interested in employing any social media that people use. As for Twitter, she added, "It just happens to be sexy right now."

Several agencies have been struggling to free themselves of bureaucratic restraints, like filtering software that bars employees from accessing social networks from work computers. In recent months, both the Department of Energy and the Department of Housing and Urban Development have opened up employee access to social-networking tools. The Defense Department has also been going online, with a new Air Force Twitter page and a Facebook page for General Ray Odierno, the U.S. commander of multinational forces in Iraq.

Nonetheless, the entire project of making the government social-network-friendly remains in its infancy. As it stands, the government controls about 24,000 websites but is only beginning to utilize the social-networking sites on which citizens are spending an increasing amount of their time. Yet the historic bureaucratic resistance to adapting to new media has clearly begun to fade, says Bev Godwin, director of Online Resources and Interagency Development at the White House. "I think you will see a huge increase in use across the government of social-networking tools," she says.

What impact does premium processing have on your application, if your file is stuck in Dallas BEC for over 3 1/2 years? Does this mean the application will be processed faster now?! Or is this only for new applicants?:(
    -----
140 premium has nothing to do with BEC labor processing. Labor processing will not speed up because of this. THis is a very calcualted move by USCIS, they are trying to speed up processing of EB3 140, but it helps noone, not Indians, Chinese or even Rest of the world.
In fact this migh even hurt us a little more if they stop concurrent processing.
